By accessing, using, or creating an account on, our Website, you expressly consent to and accept the information collection, disclosure and use practices described in this privacy policy.  This privacy policy is governed by our Website Terms and Conditions, which includes all disclaimers of warranties and limitation of liabilities.  All capitalized terms used but not otherwise defined in this privacy policy have the respective meanings assigned to such terms in our Terms and Conditions.

If we ever combine Usage Information or Third Party Information with Personal Information or other information that enables you to be identified, we will treat such combined information as Personal Information.

    SMS Opt-In and Out

    By providing your mobile phone number and deadline information, and electing to opt-in to our SMS messaging program via our website or by sending us an opt-in text message, you hereby affirmatively consent to FSA Store’s use of your mobile phone number for calls and texts (including prerecorded and/or by automatic telephone dialing systems) in order to provide you with (i) order confirmations; (ii) reminder notifications regarding your account deadline; (iii) information and reminders regarding certain eligible product offerings and promotions; (iv) information and reminders regarding certain product specials, deals and discounts; and (iii) any push notifications delivered by us. We will not assess any charges for calls or texts, but standard message charges or other charges from your wireless carrier may apply. Deadline information provided is based solely on your input; we cannot confirm the validity of the information provided. If you have any questions or need assistance regarding any text message received, you can text us “HELP” to receive assistance. You may opt-out of receiving text messages from us by texting “STOP” in response to any texts. You may opt-out of receiving calls from us by stating that you no longer wish to receive calls during any call with us, or by emailing opt-out-calls@hsastore.com and specifying you want to opt-out of calls. You understand that we may send you a text confirming any opt-out by you.

    Email Notifications and Opt-Out

    We maintain a strict “no-spam” policy. Unless you requested otherwise in your account settings at the time of your initial registration or specifically opt out as provided herein, by accepting the Terms and Conditions and this privacy policy, you expressly agree that we may use your Information to contact you by email in order to deliver you information that is relevant to your use of our Website such as administrative notices, product/service enhancements or “newsletters”, or that, in some cases, is targeted to your interests, such as targeted advertisements, or information about certain eligible products (including deals, discounts or other promotions for such products) that we believe you may be interested in learning more about. You may choose to stop receiving these email communications from us by following the instructions included in such communications or by accessing your account at My Account, located here, and changing your email notification and communications preferences. If a third party vendor provides such newsletters, you may unsubscribe in accordance with the instructions provided by such third party. If you are having problems unsubscribing please contact us at privacy@hsastore.com (forwarding the newsletter, if applicable, and including in the Subject line the words “Unsubscribe”), and you will be removed within seven (7) business days. Please note that we will not process any unsubscribe requests submitted as direct replies to any newsletter.

    Children

    You must be 18 years of age or older to use our Website or order products from FSA Store. We are committed to protecting the privacy and rights of children online. To that end, no part of our Website is directed towards persons under the age of 18 and we do not collect any Personal Information from users who we know are under the age of 18. If you are under 18 years of age, then please do not use or access our Website at any time or in any manner. Should we discover or be informed that a child has submitted his/her or another child's Personal Information, we will delete such information.

    Information Sharing

    We may share aggregated Usage Information and we may otherwise disclose non-Personal Information that we collect to third parties. However, absent your prior consent, we will share your Personal Information with third parties only in the ways that are described in this privacy policy. We do not sell your Personal Information to third parties.

    We may use third parties to outsource one or more aspects of our business and/or Website operations (such as email or customer service functions, data processing, payment processing, product order fulfillment and shipment services, web analytics, maintenance, online advertising, fulfillment and administration of product/service promotions and deals, and security execution and clearing services), in which case, we may provide your Personal Information to such third parties in connection with the performance of such activities.     FSA Store is a United States company. Information collected by us may be stored and processed in the United States or any other country in which we or our agents maintain facilities.     Our Site includes in particular hyperlinks to an eyewear/optical prescription fulfillment, and pharmacy prescription fulfillment, websites. The FSA Store terms and conditions and this privacy statement do not extend to such eyewear/optical and prescription fulfillment websites and we therefore encourage you to review the terms and conditions and privacy policy of such fulfillment websites before accessing, using or providing any Information to such websites. Any Personal Information, including prescription and credit card information, that you provide via the eyewear/optical and/or prescription fulfillment websites, will be governed by the terms and conditions and privacy policy of such websites. FSA Store does not receive or access any personal or health information that you may provide to the eyewear/optical and/or pharmacy prescription services, via the fulfillment websites, and such eyewear/optical and/or pharmacy prescription services are prohibited from sharing your information with FSA Store.

    Do Not Track Requests

    Please note that your browser setting may allow you to automatically transmit a “Do Not Track” signal to websites and online service you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context.     Additional Policy Information

    Event of Merger, Sale or Bankruptcy

    In the event FSA Store is acquired by or merged with a third party entity, or sells all or substantially all of its assets, we reserve the right, in any of these circumstances, to transfer or assign the Information we have received and collected from you as part of such merger, acquisition, sale, or other change of control.     Sweepstakes, Contests and Promotions

    We may offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration.     To De-Activate your account, email privacy@hsastore.com and include “De-Activate My Account” in the subject line. We will use commercially best efforts to complete your request within five (5) business days, but note that your account information will still remain in our system following de-activation.

If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on our Website prior to the change becoming effective.
